Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of SourceWatch (the “Service”), operated by Enzak Inc (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you’re using the Service for an organization, you represent that you’re authorized to bind it.

2. The service

SourceWatch measures how AI search engines reference your brand and tracks AI crawler and referral traffic to sites you control. Results are provided for informational purposes; AI systems change constantly and we don’t guarantee any particular ranking, citation, mention, or outcome.

3. Accounts

You’re responsible for your account, your credentials, and all activity under it. Provide accurate information and keep it current. Notify us promptly of any unauthorized use via our contact form.

4. Plans, trials & billing

  • Paid plans, free trials, included allowances, and optional add-ons are described on our pricing page. Trials are capacity-capped and do not bill you.
  • Where paid plans are offered, fees are billed in advance for the cycle you choose; each plan includes a monthly allowance, and checks pause when it is reached — there are no overage charges.
  • You authorize us and our payment processor to charge your payment method for your plan and any add-ons you select. Taxes may apply.
  • Except where required by law, fees are non-refundable. You can cancel future renewals at any time.

5. Acceptable use

You agree not to:

  • Install the capture layer on, or track, any site you do not own or have permission to monitor.
  • Use the Service to violate any law or third party’s rights, or to collect data unlawfully.
  • Reverse engineer, resell, or abuse the Service, overload our infrastructure, or circumvent usage limits or security.
  • Upload malicious code or attempt to gain unauthorized access to the Service or other tenants’ data.

6. Your data & responsibilities

You retain ownership of the sites, prompts, and data you bring. You grant us the rights needed to operate the Service for you. You’re responsible for having a lawful basis and any required notices/consents for the visitor analytics our capture layer collects on your sites — for which you are the controller and we are your processor, as described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, and content, is owned by Enzak Inc and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. All rights not expressly granted are reserved.

8. Third-party services

The Service relies on third parties (including AI engines, hosting, and delivery providers). We aren’t responsible for their availability, accuracy, or acts, and their terms may apply to data they process.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that results are accurate, complete, or uninterrupted.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENZAK INC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You’ll defend and indemnify Enzak Inc against claims arising from your use of the Service, your data or sites, or your breach of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or non-payment. On termination, your right to use the Service ends; certain provisions survive (e.g. IP, disclaimers, limitations, indemnity).

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Courts located in that jurisdiction have exclusive venue, except where applicable law provides otherwise.

14. Changes & contact

We may update these Terms; material changes will be notified and the “last updated” date revised. Continued use after changes means you accept them. Questions: use our contact form.
